1. Applicability
These general terms and conditions apply to all offers, quotations, work, assignments and agreements between Fixels and the client.
2. Execution of the agreement
Fixels will execute the agreement to the best of its knowledge and ability and in accordance with the requirements of good workmanship. If and insofar as a proper execution of the agreement requires this, Fixels has the right to have certain work done by third parties.
3. Prices and payment
All prices are exclusive of VAT and other government levies. Payment must be made within 14 days of the invoice date, in a manner to be indicated by Fixels.
4. Intellectual property
All documents provided by Fixels, such as designs, sketches, drawings, films, software, (electronic) files, etc., are exclusively intended to be used by the client and may not be reproduced, made public, or brought to the notice of third parties by him without prior permission from Fixels.
5. Liability
Fixels is only liable for direct damage. Direct damage exclusively means the reasonable costs to determine the cause and extent of the damage. The liability of Fixels is in any case always limited to the amount of the payment of its insurer in the appropriate case.
